Resale

A Resale Certificate (TREC 37-2) and attachments will need to be obtained from the management company for the HOA (HOA Management) before a home can be sold to another person or company. The cost is $175 per packet, and packets are valid for 90 days once issued.

Among other documents, included in the information packet will be:

• a copy of the HOA Bylaws,
• a copy of the HOA Covenants,
• a copy of the HOA Community Beautification Standards,
• the most recent HOA newsletter, and
• a new homeowner information form to be acknowledging receipt and acceptance of these items.

You will need to pass all of these items along to the title company at close. The new homeowner information form will need to be signed and returned to the management company upon close. If you would like an advance copy of these documents prior to receiving the packet, you may also download and print copies from the HOA web site at http://www.maxwellcreek.org/.

Once notified, the management company will contact you to coordinate the delivery / pick-up of the packet containing the Resale Certificate. Typical turnaround time will be 3 to 5 days, although Texas law allows for at least 10 days.

Expedited (same-day) resale requests may be made, at an additional cost of $50.

Realtor For-Sale Signs

Realtors must limit their signs to one (1) sign on the property. No other signs are permitted for a property sale and will be removed and discarded, especially signs located on HOA common property.

Article IV, Section 1(c) of the HOA Covenants states:

No excessive signage shall be displayed to the public view on or from any part of any lot. This shall not prohibit the temporary use of signs by Declarant or any Owner, advertising the lot for sale or rent, or signs of architects and builders during the period of construction and sale of improvements on any lot. The size of these signs shall not exceed five square feet.

The HOA reserves the right to remove any sign that exceeds these specifications.

Home Refinancing

Refinancing a mortgage will not require a Resale Certificate, but a Mortgage Company or Title Company may want a letter or email from the HOA stating the dollar amounts of unpaid dues or other unpaid assessments on the property. Many companies also ask for copies of any HOA insurance policies. The cost is $75 per packet.

Once notified, typical turnaround time via return email will be 1 to 3 days.
