Annual Meeting Agenda
1st Calling - Monday, April 7th, 2008

  1. Welcome
    • Verification of Quorum
      Section 5.2 Member in Good Standing. A Member of the Association shall be considered to be a Member in good standing and eligible to vote if such Member:
      1. Has, not less than seven (7) days prior to the taking of any vote by the Association, fully paid all assessments or other charges levied by the Association then due and payable, as such assessments or charges are provided for hereunder and in the Declaration; and
      2. Has discharged all other obligations to the Association as may be required of Members hereunder or under the Declaration.
      Section 5.5 Notice and Quorum. The presence of Members or of proxies or voting representatives holding forty percent (40%) of all the eligible votes of the Association, regardless of the class, shall constitute a quorum. If the required quorum is not present, another meeting may be called subject to the same notice requirements, and the required quorum at such subsequent meeting shall be one-half (½) of the quorum requirement for such prior meeting.
    • We need 108 homeowners total in person or by proxy in order to reach a quorum. If a quorum cannot be reached, a notice will be mailed for a second calling on April 21st.

    Architecture
    The management company mailed 272 violation notices to 133 different homeowners in 2007. So far this year, the management company has mailed 103 violation notices to 84 different homeowners. While some items have cleared up, the two big items that continue are weeds in yards and maintenance in alleyways.
    Landscape
    We changed landscape maintenance companies twice last year after our previous company, Perfecto, went out of business. We believe the current company, Lindsey's Landscaping, to be doing a good job taking care of the property. They have treated the Common Areas for weeds three times thus far in 2008. We had additional soil and sod added to several areas (primarily along Bethany and Maxwell Creek Dr.), and seasonal flowers were added at both the north and south entrances.
    There have been fewer incidents of vandalism and damage to the brick fence along Shelley, although there was an incident involving graffiti on the south entrance sign in February.
    Social
    The next big event for the year is (the neighborhood block party on Saturday, April 26th), and planning is underway!
  5. Board of Directors and Voting Member Elections
    • Review voting procedures.
    • Introduction of candidates.
      • Previous Board Members Robert Butler and Yesika Fletcher are running for reelection.
    • Nominations from the floor.

  6. Community Improvements / Topics for 2008
    • HOA won suit against it by out-of-state homeowner regarding registered mailing address, including judgement in HOA's favor for payment of all associated legal fees.
    • Two large write-offs of dues, interest, and fees — $5,940.58 total — from two foreclosed properties: 1616 Briarhollow Ct. and 1715 Mapleleaf Falls Dr.
    • Upcoming construction and other activities occurring in the surrounding area.
      • Kroger expansion was originally scheduled to be completed by end of April, has been pushed back several months.
      • Studio Movie Grill is no longer planned for Bethany and 75.
