With regards to the letter mailed by your firm dated September 20, 2006 concerning Neighborhood Management, Inc. ("NMI"):

The documents cited, "The Villages at Maxwell Creek HOA Newsletter (3rd Quarter 2006)" and the August 26, 2006 Minutes of the Board of Directors of the Maxwell Creek Homeowners Association, report a fair and true telling of the circumstances surrounding and ultimately leading to the recent termination of NMI's contract.

Therefore, we recommend your client drop their complaint as it has no basis in fact.

Should further action be sought by your client, we recommend they review case law surrounding fair comment and criticism and the additional burden of proof on the plaintiff showing that said statements are false.
